English translationThe blood of a Muslim person is not lawful except for three matters: whoever kills is killed, for killing a Muslim soul; the previously married adulterer, the married man who commits adultery; and the one who abandons his religion and separates from the community. These are three reasons for which it is permissible to kill a Muslim. And the one who kills him is not me or you, and the one who kills him is not the tribe or the family. No. Rather, it is the ruler in charge of the Muslims, or the ruler of the Muslims, or the judge in the region, who carries out the judgment of God.

A warring disbeliever, right? A disbeliever that we're at war with ... apostate and ... someone who has been ... a fornicator who was chaste or an adulterer, right? ... Because the Sharia has ordained that they are to receive the punishment of execution, right? If the Sharia is already saying that they're executed, and then you're gonna go and try to save their life by breaking your fast, no. Their life was supposed to be gone anyways, right? So it doesn't make any sense.

when someone leaves the fold of Islam or commits treason then it is permissible for them to be killed but even still it's not your decision or my decision it has to come from the sultan or the imam or the Amir al-Mu'minin, or if a judge, if a hakem or a qadi, then gives the hadd, gives the punishment for this. Just you or I just can't say, well, someone committed treason, then we go shoot him in the head. This is Islam—respects the law and order. This would be un-Islamic. Islam respects law and order, dear brothers.

English translationLike the apostate in the history of Islam: among us, the apostate is killed. But what is the reason for the killing? Is it apostasy, meaning is he killed because he is an apostate, or is he killed because he is a combatant [waging war against Islam]?... If a person apostatizes and stays in his house, Islam will not come and snatch him from his house to the place of execution and carry out the legal punishment on him. But if a person apostatizes and announces his apostasy, especially if he is a writer or thinker or an influential person, and announces that he has apostatized and so on, this poses a danger to the religion because, I mean, he harms the religion... So I also hold the view that the reason for killing the apostate is that he is waging war [against the religion]. This man, if he had stayed silent, we would not have killed him, but when he declared and publicized his apostasy, he is killed for this.

If he does not repent, i.e., if he does not recant his belief with the two testifications of faith, he is asked to repent, i.e., he is ordered to return to Islam through the two testifications. Nothing is accepted from him except Islam or execution. The caliph executes him according to the conditions mentioned in the long books... That's only the job of a legitimate Muslim ruler, and we're in a non-Muslim jurisdiction. So nobody possesses that authority here. We cannot apply prescribed punishments, um, in this environment. It's not permissible.

The blood of a Muslim who bears testimony of faith, there is no God but Allah, Muhammad is the messenger of Allah, is not permissible to be shed except in three cases. Number one, an adulterer who is married. Number two, a soul for a soul, a nafsu bi’l-nafsi. And number three, a murtad or an apostate, a person who abandons his or her religion and deserts the jama’a, the community.

English translationSo the issue is that the Lawgiver has ordered the killing of the apostate for whoever openly declares disbelief; there is a difference between disbelief and declaring disbelief openly - whoever among the Muslims openly declares disbelief is to be killed.

this goes back to why some of the rulings regarding the murtad are so harsh you know sometimes people ask you know how come in islam you know a person who leaves islam and you know then you know he's executed and it's a very very difficult punishment it's a capital punishment and so on people fail to understand what was happening in madina this was part of the strategy of the hypocrites to enter islam stay there for a few days months or whatever and then leave it to encourage others to leave as well and that was a big fitna so in order to stop such fitna very very strong actions were taken against these people

English translation...except by the right of Islam. That is, unless someone truly has to be killed in a proper, lawful manner. For example, if someone has killed someone, then in retaliation, as retributive punishment (qisas), he will be killed. Similarly, if a man leaves Islam, that same procedure applies to him too. And third, if a muhsan (a married person) commits illicit sex (zina), that is, a married man commits the act of zina, then his life will be taken. These are the three things because of which a person can be killed. Who will carry this out? The government will do it.
